New employee booking procedure: everything businesses need to know

Since December 1, 2024, a new procedure for reserving military personnel has come into effect in Ukraine, which introduces significant changes to the process of protecting key personnel for enterprises. Resolution of the Cabinet of Ministers No. 1332, supplemented by Resolutions No. 1361 and No. 1362, has created clear rules and requirements that enterprises must adhere to.

The new procedure aims to eliminate the shortcomings of the previous system, which was often opaque and allowed for abuse. Now, employee reservation will become more transparent thanks to the automation of processes and clear criteria for enterprises.

Who can obtain the status of a critical enterprise?
The status of a critical enterprise allows a business to reserve its employees even during mobilization. However, this status is available only to those companies that meet the established criteria.

Such enterprises include:

State and local government bodies that ensure the functioning of state administration.

Companies with state contracts in the defense sector (for example, suppliers of equipment or machinery).
Critical enterprises for the economy or vital activities of the population (energy, food industry, utilities, etc.).

Criteria for obtaining the status
To obtain the status, an enterprise must meet three criteria:

Mandatory criteria:

The average salary at the enterprise is at least 20 thousand hryvnias.
Absence of tax and social security debt.
Additional criteria (one of):
Payment of taxes in excess of 1.5 million euros per year.
Foreign exchange earnings in excess of 32 million euros per year.
Inclusion in the list of strategic enterprises.
Importance for the industry or region.
Resident status of Diia.City.
Enterprises that do not meet these criteria will not be able to book employees. Therefore, before submitting an application, it is important to carefully check whether your business meets these requirements.

How does booking work through Diia?
Thanks to the introduction of digital technologies, the process of booking employees has been significantly simplified. Now the entire procedure takes place through the Diia portal.

Step-by-step instructions:

Authorization: Log in to the Diia portal using an electronic signature.
Service selection: Select the "Employee booking" section.
Data filling: Enter information about the employees you plan to book.
Salary confirmation: Confirm that the salary of each employee is at least 20 thousand hryvnias.
Signing the application: Sign the application with the electronic signature of the company manager.
Waiting for the result: The result of the application processing will be received within three business days.
Successfully booked employees will be displayed in the "Reserve+" system.

What has changed in the verification procedure?
One of the key innovations is a simplified salary verification mechanism. Now, to make a reservation, you do not need to prove that the employee received 20 thousand hryvnias in previous periods. It is enough to confirm this salary level from the moment of booking.

This change is important for enterprises in regions where average salaries may be lower. It allows companies to adapt to new requirements without additional financial burden.

New opportunities for booking
The government has also expanded the list of categories of employees who can be booked without restrictions:

Tactical medicine instructors.

Drone operators.
Electronic warfare specialists.
Specialists in prosthetic and orthopedic production.
In addition, enterprises implementing humanitarian projects with the support of international partners have received simplified access to the booking procedure.

Risks and consequences of violations
It is important to understand that submitting inaccurate salary data or other information can have serious consequences:

Loss of status: The enterprise loses its critical status and will not be able to restore it within 6 months.
Refusal to book: If it turns out that the employee does not have current military registration documents, the booking may be canceled.
Therefore, before submitting an application, it is necessary to carefully check all documents and data.
