What questions are most often asked to a military lawyer?

With the beginning of hostilities and general mobilization, many citizens are faced with various legal issues related to military service and mobilization processes. The Olson Law Firm receives many requests for consultations related to these issues. Today we will share answers to the most common questions that our clients ask a military lawyer.

1. Can I be detained by TCC and SP employees on the street?

This question often worries citizens who are afraid of illegal actions by territorial recruitment and social support centers (TCC and SP). By law, TCC employees do not have the right to detain citizens on the street. The only ones who can legally detain a person are police officers, and only in cases clearly stipulated by law. If TCC employees try to detain you, it is important to remain calm and seek legal help.

2. What should I do if I am detained by TCC employees?

If you are still in a situation where you are detained by the CCC, first of all, we recommend that you call the Olson law firm. We are ready to provide advice and protect your rights. If you do not have a medical card or other important medical documents with you, you have the right to refuse to undergo a military medical examination (MME) until you provide the necessary information about your health.

3. Do I have the right to a deferral if my wife or parents have a disability?

Yes, under certain conditions you have the right to a deferral from conscription. The law provides for a deferral for citizens if their close relatives (for example, their wife, mother, father or their parents) have a disability. For a detailed analysis of your situation and more specific advice, you can contact us in person or sign up for an online consultation.

4. What should I do if the MME has found me fit, but I believe that I am unfit?

This is a very common question. In many cases, it happens that the decision of the VLK does not reflect the real state of a person's health. If you believe that you were mistakenly found fit, you have the right to appeal the decision of the VLK. The Olson Law Firm has extensive experience in resolving such cases and will help you successfully appeal the commission's decision.

5. How do I travel abroad during martial law?

Traveling abroad is possible only if there are legal grounds that are clearly defined by law. The list of such grounds is exhaustive and is publicly available. If you have one of these grounds, you can travel abroad. If there are no grounds, then, unfortunately, there are no legal opportunities to travel.

6. What to do if a new law has been issued?

Many people contact us with questions about new laws immediately after they are adopted. However, it is important to understand that each new law requires careful analysis. It is impossible to provide competent advice immediately after the law is issued, because this requires time to study it. Olson Law Firm always monitors changes in legislation and is ready to provide qualified assistance as soon as all the nuances are clarified.

7. Why does the issue of deferment take so long to be considered?

The duration of obtaining a deferment depends on the specific CCC where you are undergoing the procedure. Unfortunately, this issue does not always depend on your desire or our influence. The responsible employee of the CCC can affect the speed of processing documents, and this process may differ in different regions. We always try to do everything possible to speed up the process, but there are factors that we cannot control.

The most common misconceptions

In addition to questions, our clients often encounter various myths and misconceptions regarding conscription and legislation. Here are some of the most common:

“The CCC said…” – you should always check the information received from CCC employees, as it may be inaccurate or incorrect.

“Reserve Plus is not a military document” is a popular myth. Documents confirming the reserve have legal force if they are properly executed.
“Lawyer requests are illegal” – this statement is false. The state is obliged to respond to requests from lawyers, and refusal to do so is a violation of the law.
“First you need to go through the VLK” – the VLK is not the first step in all cases. It is important to correctly understand the procedures, depending on your situation.
Olson Law Firm is always ready to help you understand complex issues related to conscription, mobilization and military service. We provide advice both online and offline in our office in Lviv. Contact us with any questions, and we will help you find the right solution!
