A charitable organization is recognized as a charitable foundation, which operates on the basis of the charter, has participants and is managed by participants who are not obliged to transfer any assets to this organization in order to achieve the goals of charitable activity. A charity fund can be created by one or several founders. Charitable fund assets can be formed by participants and/or other benefactors.

The statute must contain information about the name of the fund, the goals and areas of charitable activity, the governing bodies of the charitable organization, their composition, competence, the procedure for their activities and decision-making, the procedure for appointing, electing or approving members of the governing bodies of the charitable organization, their replacement, termination of their powers, termination of their powers (revocation), the procedure for making changes to the founding documents, sources of assets (income), the procedure for control and reporting, the grounds and procedure for terminating a charitable organization.
The charter of a charitable foundation must also contain the conditions and procedure for accepting members of a charitable society or a charitable foundation, the rights and obligations of participants, as well as the conditions and procedure for their exclusion from the membership of a charitable society or a charitable foundation. These documents must be drawn up in accordance with Ukrainian legislation, and the statute should preferably be notarized.
3. Submission of documents for state registration: After drawing up the founding documents, you must submit them to the state registrar, Administrative Services Center or notary public to register your foundation. 4. To obtain the status of a non-profit organization, registered institutions and organizations (newly created) must submit a registration application in form 1-RN to the state to the registrar at the time of their state registration or to the controlling body (Tax) at the main place of registration within 10 calendar days from the day of their state registration. This will entitle the charitable organization to exemption from paying income tax, when receiving funds from both residents and non-residents.
