A note about violating military registration rules in "Reserve+": what to do?

Since the introduction of the Unified State Register of Conscripts, Military Conscripts and Reservists, every citizen of Ukraine subject to military service can check his military registration data through the mobile application "Reserve +" or the portal "Diya". However, recently more and more people have been finding a mark in their electronic military registration documents about a violation of the rules of military registration.

What does this mark mean? What can be the consequences for those subject to military service? Can it be appealed and how to act in such a situation? In this article, we will consider in detail all aspects of this problem and give recommendations for further actions.

What does a mark about a violation mean in "Reserve +"?
The mark "violation of the rules of military registration" means that a citizen subject to military service has violated the established rules of military registration, and the territorial center of recruitment and social support (TCK and SP) has applied to the National Police with a request to search for him or deliver him for drawing up an administrative protocol.

This information is entered in accordance with the Resolution of the Cabinet of Ministers of Ukraine No. 559 and contains data on:

Appeal to the police regarding an administrative or criminal offense.

The fact of drawing up an administrative report or the impossibility of drawing it up on the spot.

Thus, this mark may lead to legal consequences, in particular, the detention of a person during the verification of documents.

Why do such marks appear?
Ukraine is actively digitizing military records, which allows state bodies to more quickly record violations and track citizens liable for military service. If earlier the information was stored in paper archives, now it is centrally updated in electronic registers.

This has significantly strengthened control over the fulfillment of military duties and led to the appearance of a large number of new marks in the "Reserve +" database.

For what can you get a mark on violation of military records?

According to the Code of Ukraine on Administrative Offenses, there are several main reasons why a conscript may receive a "Reserve+" mark:

Failure to appear for a summons that was delivered in person or sent by mail.
Ignoring a call to pass a military medical commission (MMC).
Not registering for military registration after reaching the appropriate age or changing their place of residence.
Evading military registration or conscription.
Refusing to update military data or ignoring the requirements of the Military Registration and Registration Service.
In most cases, people do not even suspect that there are violations, but receive this mark due to formal errors or untimely updating of their military registration data.

What are the consequences for conscripts?
A "Reserve+" mark is not just an entry in the database, but a real threat of detention and prosecution.

If a conscript has such a mark, the following consequences are possible:

The police may detain you during a document check.

You may be forcibly taken to the CCC and SP to draw up a report on an administrative offense.
You may be fined from 17,000 to 25,500 UAH.
In case of evasion of military registration, criminal liability is possible.
You will not be able to receive a reservation from mobilization.
Thus, every conscript must carefully monitor his military registration and know his rights.

What to do if you have a violation mark?
If you find a violation mark in "Reserve +", the main thing is not to panic. Act according to the following recommendations:

Contact a military lawyer. You should not immediately go to the military registration and enlistment office without legal advice.

Check the reason for the mark. Find out what exactly it was given to you for.
Do not ignore the situation. If there is a mark, you may be stopped on the street or while crossing the border.
Appeal an illegal decision. If you are sure that the mark was made by mistake, you need to file a complaint or go to court.
If you have been fined, the fine can be appealed. Many fines are recognized as unlawful in court.
In the event that you are unlawfully entered in the register of violators, you must demand official explanations from the CCC and appeal the actions in court.

Digitalization of military records is a step towards a more transparent and efficient mobilization system, but it also creates risks for those who are not familiar with the law.

It is very important not only to fulfill military duties, but also to protect your rights in cases of unlawful decisions or erroneous sanctions.

To avoid potential problems:

Regularly check your military registration data in "Reserve+" or "Diya".
Consult with lawyers before taking any action regarding military registration.
Do not postpone resolving the problem if you have a mark.
The introduction of violation marks in "Reserve+" is an attempt by the state to strengthen control over military registration. However, not all of these marks are justified, and not all conscripts really violate the law.
