Features and restrictions of the first obtaining a driver's license in Ukraine

In Ukraine, the issuance and exchange of driver license is one of the most relevant topics and the most popular service provided by the service centers of the Ministry of Internal Affairs of Ukraine. This issue is regulated by the Resolution of the Cabinet of Ministers of Ukraine "On approval of the Regulations on the procedure for issuing driver's licenses and admission of citizens to drive vehicles" № 340 of May 8, 1993.

In Ukraine, the issuance and exchange of rights is one of the most relevant topics and the most popular service provided by the service centers of the Ministry of Internal Affairs of Ukraine. This issue is regulated by the Resolution of the Cabinet of Ministers of Ukraine "On approval of the Regulations on the procedure for issuing driver's licenses and admission of citizens to drive vehicles" № 340 of May 8, 1993.

However, this law has undergone a number of amendments to additions before acquiring its current form. The decision in its original form has long provided for the issuance of a document confirming the right to drive a vehicle for 30 years, regardless of whether it was issued for the first time.

Due to the high number of accidents and the high death rate in car accidents in 2017, the Ministry of Internal Affairs has set itself the task of considering such issues as changing the validity of driver's licenses and setting speed limits to reduce the number of negative indicators.

The new norms are enshrined in the Resolution of the Cabinet of Ministers “On Amendments to the Regulations on the Procedure for Issuing Driver's Licenses and Admission of Citizens to Drive Vehicles” № 885 of November 10, 2017.

From now on, the legislative amendment stipulates that a driver's license issued to a person for the first time is valid for two years from the date of its issuance with a limited right to drive a vehicle. This restriction prohibits exceeding the speed of 70 kilometers per hour.

In Ukraine, the issuance of driver's licenses is based on the following algorithm:

  • Attending classes at a driving school
  • Passing a medical examination and obtaining a medical certificate
  • Passing practical and theoretical exams in the service center of the Ministry of Internal Affairs
  • Obtaining a temporary driver's license.

Paragraph 25-1 of the Resolution of the Cabinet of Ministers of Ukraine № 885 stipulates that the exchange of temporary rights after its expiration is carried out without passing examinations, provided that a person commits no more than two administrative offenses in the field of road safety and failure to commit a criminal offense. offense under Art. 286 of the Criminal Code of Ukraine.

If a person commits three or more administrative offenses and as a result loses the right to drive a vehicle, his rights are not returned. They can be obtained only by re-passing the medical examination and passing practical and theoretical exams in the service center of the Ministry of Internal Affairs.
