Who is allowed to leave Ukraine abroad and what is required for this

In the conditions of martial law, which was introduced in Ukraine in connection with the Russian aggression, travel abroad for conscripted men is significantly limited. This limitation has several important reasons. First, it is aimed at maintaining the national security and defense capabilities of the country, ensuring the availability of a sufficient number of people for mobilization and the execution of military tasks. Secondly, the restrictions on departure are designed to prevent mass migration of men of military age, which can significantly weaken the economy and defense capabilities of the state.

However, the legislation of Ukraine provides certain exceptions to this rule. Decree of the Cabinet of Ministers of Ukraine No. 57-95 establishes specific categories of citizens who can go abroad even during martial law. These categories include persons with relevant social or medical reasons, as well as those engaged in certain professional activities.

To exercise this right to leave, it is necessary to comply with a number of requirements and have all the necessary documents. Below are detailed descriptions of the categories of citizens who have the right to leave, and a list of documents confirming their grounds.

Categories of citizens who have the right to leave:
Men with disabilities of the I, II or III groups Disabled people of the first, second or third group have the right to travel abroad. To confirm this status, it is necessary to provide documents certifying disability issued in Ukraine. Disability established abroad does not grant the right to leave.
Men accompanying persons with disabilities or seriously ill relatives If a man accompanies a person with disabilities of group I or II or a seriously ill relative, he has the right to leave only with this person. Independent departure, even with all the necessary documents, is not allowed.
Parents with many children Men who have three or more minor children can go abroad. To do this, you need to provide documents confirming the birth of children, a marriage or divorce certificate, as well as proof of child maintenance if the husband does not live with them.
Men raising children on their own If a man is raising children on his own, he also has the right to travel abroad. These can be men whose child's mother died, or whose mother was deprived of parental rights.
Servicemen going for treatment, rehabilitation or training Servicemen who are sent for treatment, rehabilitation or military training abroad can leave if they have the appropriate referral and documents from the Ministry of Health or a military unit.
Male drivers of international flights Male drivers of international flights can travel abroad provided that their company has a license for international transportation.
Male volunteers Volunteers engaged in the transportation of goods for the Armed Forces, medical goods or humanitarian aid can leave under the special program "Slyah".
Railwaymen and sailors Men working on international railways or in sea transport can go abroad with an employment contract and a letter from the employer.
Athletes and coaches Athletes and coaches can travel abroad by decision of the Ministry of Youth and Sports, which includes them as participants in sports events or competitions.
Workers in the field of culture Men working in the field of culture can travel abroad with the permission of the Ministry of Culture and an invitation from the organizer of the event.
Men whose relatives died or went missing Men whose close relatives (wife, son, daughter, father, mother, brothers or sisters) died or went missing during the anti-terrorist operation or during martial law have the right to leave. To confirm this status, it is necessary to provide documents certifying family ties and the fact of death or disappearance.
Men excluded from military registration due to health status Men who were excluded from military registration due to health status can go abroad. These can be men with disabilities or those who are recognized as unfit for military service by the decision of the medical commission.
Men temporarily unfit for military service Men who are temporarily unfit for military service for a period of up to 6 months can also go abroad. This is confirmed by the conclusion of the military medical commission.
The legislation of Ukraine regarding the departure of conscript men abroad is complex and constantly changing. This is due to the fact that the situation in the country can change quickly, and the government must quickly respond to new challenges. Such changes in legislation can be aimed at ensuring national security, maintaining mobilization readiness, as well as taking into account the socio-economic needs of society.

It is important to understand that even if you have all the necessary documents, the right to travel abroad is not automatic. The final decision on the possibility of crossing the border is made by the border services

, which are governed not only by legislative acts, but also by internal instructions and current orders. Therefore, people planning to leave should take care in advance of having all the necessary documents and make sure they are up-to-date.

In addition, it should be taken into account that documents confirming disability, temporary unfitness for service, family ties with deceased or missing relatives must be issued by the competent Ukrainian authorities. Documents received abroad may not be recognized by Ukrainian border services. This means that it is necessary to receive all certificates and confirmations from the relevant state institutions of Ukraine in a timely manner.

It is also worth noting that special conditions and departure programs apply to certain categories of citizens, such as volunteers, drivers of international flights, railway workers, sailors, athletes, coaches and cultural workers. These conditions may change depending on the current needs of the country and international cooperation. Therefore, representatives of these professions should constantly monitor changes in the relevant regulatory acts and contact their employers or relevant ministries for clarifications and necessary documents.

Finally, it is important to remember that failure to comply with the legal requirements for traveling abroad can lead to serious consequences, including refusal to cross the border, administrative or criminal liability. Therefore, everyone who plans to leave should carefully prepare, familiarize themselves with the current requirements and ensure that they have all the necessary documents.
