Is the salary at the place of work retained for a military serviceman?

In today's difficult situation in Ukraine, the issue of protecting the rights of military personnel is of particular importance. One of the most relevant aspects is the preservation of wages at the place of work for those who go on military service. This issue is of great importance not only for the military personnel themselves, but also for their families. Let's try to figure out how the legislation of Ukraine regulates this aspect and what guarantees it provides.
Legislative framework
The legislation of Ukraine provides for certain guarantees for employees who are drafted or voluntarily joined the ranks of the Armed Forces of Ukraine. The main regulatory legal act regulating this issue is the Labor Code of Ukraine (LCA) and the Law of Ukraine "On Social and Legal Protection of Military Personnel and Members of Their Families".
According to the LCA of Ukraine, the employer is obliged to preserve the workplace and average earnings of an employee who is drafted for military service or undergoes military training. This means that the serviceman retains his position and the level of pay that was at the time of conscription.
Conditions for maintaining wages
In order for an employee to maintain his wages, a number of conditions must be met. First, the employee must provide the employer with a document confirming his conscription for military service. This may be a summons from the military enlistment office or another official document.
Secondly, it is important that the employee is officially employed. This means that an employment contract must be concluded between the employee and the employer, and the employee must be included in the staff of the enterprise or organization. If the employee worked unofficially, the employer is not obliged to maintain his job and wages.
Amount of payments
The amount of payments retained by a serviceman is determined based on the average earnings for the last 2 months before conscription. Average earnings are calculated in accordance with the Procedure for calculating the average wage, approved by the Cabinet of Ministers of Ukraine.
It should be noted that in the event that a serviceman is transferred to another place of work or takes up another position with a higher salary, the new employer is also obliged to maintain his average earnings based on the new, higher salary.
Duration of salary retention
The duration of the period during which the employee's salary is retained depends on the type of military service. For employees undergoing compulsory military service, the salary is retained for the entire term of service, but not more than one year.
If the employee was called up for military service, the salary is retained for the entire period of the service. In the event of mobilization of an employee in connection with a special period or the introduction of martial law, the employee's job and average earnings are retained for the entire period of mobilization, but not more than one year.
Return to work
Upon completion of military service, the employee has the right to return to his previous place of work. The employer is obliged to accept him back and provide all the conditions that existed before the call-up. If at the time of return the employee's position was reduced, the employer must offer another job that is not lower in terms of pay and qualifications.
Conclusion
The legislation of Ukraine provides significant guarantees for military personnel, including the preservation of their job and salary at the place of work. These guarantees are aimed at ensuring the social protection of military personnel and their families in difficult conditions. However, it is important to remember that in order to exercise these rights, it is necessary to follow certain procedures and provide the relevant documents to the employer in a timely manner.
